Profile
Andrew heads up a new department at MLR launched in January 2010 specialising in the representation of corporate and institutional clients in both private and public sectors who may face investigations by regulators such as Local Authorities, devolved agencies such as the Care and Social Services Inspectorate Wales (CSSIW) and other prosecuting agencies such as the Health and Safety Executive.
Andrew is an experienced Advocate with rights of audience before all levels of court. Examples of his experience include the following:
- Care Standards: investigations by CSSIW of Welsh providers of care homes and Health Inspectorate Wales regulation of private healthcare providers. Recent cases have included a joint Police/CSSIW investigation into the deaths of two service users in West Wales and an ongoing Police and Ofsted investigation into a large provider of nursery settings involving unexplained fractures to children. Andrew has also advised a number of care home providers in relation to Deprivation of Liberty Safeguards (DOLS) cases since their introduction in April 2009.
- Health and Safety and Corporate Manslaughter: cases include one of the first investigations of a UK company under the Corporate Manslaughter Act; a double fatality carbon monoxide poisoning and representing the Health and Safety Consultant of an international chain of Hotels in a double fatality Legionnaires outbreak.
- Serious Tax Fraud and other Financial Crime: cases include a £50M EC VAT fraud; an off-shore serious tax fraud investigation by the Special Civil Investigations unit of HMRC; £11M alleged fraud involving EC matched funding.
- Money Laundering and Asset Restraint and Confiscation: cases include a £800K foreign cash seizure with cross border litigation; intervening on behalf of a commercial landlord whose properties had been made subject of a Restraint Order in criminal proceedings against a tenant and securing the release of the properties from the Order.
- Regulatory Investigations and Enforcement: cases include a large scale Trade Marks Act prosecution against a wholesale importer of CPU components on the "grey" market; fire safety prosecutions against a major regional retailer; trading standards prosecution against a leading franchised car dealer for misleading "sales" promotions; a prosecution brought against a Pharmacist and fitness to practice proceedings by the RPS for breaches of the Medicines Act.
- Armed Forces Investigations: Andrew has for many years represented Welsh Forces personnel and their families in a range of investigations and has extensive experience of representing servicemen before Courts Martial. Prior to MOD downsizing Andrew ran a free monthly legal advice surgery at RAF St Athan for servicemen and their families.
